Terms of Service

These Terms of Service (the “Terms”) govern your use of the Eko mobile application and related services (together, “Eko”, the “App”, or the “Service”), operated by Omry Hoomash (“we”, “us”, or “our”). By downloading, accessing, or using Eko, you agree to these Terms. If you do not agree, please do not use the App.

1. The Service

Eko is a guitar effects and tone application. It lets you build virtual pedalboards, process your guitar signal in real time through audio effects, generate tone presets (including AI-assisted suggestions), and save and manage your sounds. Some features are free; others require a paid subscription (see “Subscriptions & Billing”).

2. Eligibility & Accounts

You must be old enough to form a binding contract in your country to use Eko. You may be able to create an account (for example, with Sign in with Apple). You are responsible for activity that happens under your account and for keeping your sign-in credentials secure. Let us know promptly if you believe your account has been used without your permission.

3. Subscriptions & Billing

Eko offers an auto-renewing subscription (“Eko Pro”) that unlocks premium features. Subscriptions are sold and billed through the Apple App Store, subject to Apple’s terms.

Refunds are handled by Apple under its policies. Your purchase is also subject to Apple’s standard Licensed Application End User License Agreement.

4. Microphone & Audio

Eko uses your device’s microphone (or a connected audio input) to capture and process your instrument in real time. We recommend using headphones for the live experience to avoid feedback. You are responsible for keeping playback at safe volumes to protect your hearing and your equipment.

5. Acceptable Use

You agree not to misuse Eko, including by attempting to reverse engineer, copy, resell, or redistribute the App or its content, interfering with its normal operation, or using it to infringe anyone’s rights or break the law.

6. Your Content

Presets, settings, and other content you create remain yours. You grant us a limited license to store and process that content solely to operate and improve the Service. You are responsible for the content you create and share.

7. Intellectual Property

Eko, including its software, sounds, designs, names, and logos, is owned by us or our licensors and is protected by intellectual property laws. These Terms do not grant you any rights in our trademarks or content except the limited right to use the App as intended.

8. Artist Names, Bands & Trademarks

Eko has no affiliation, association, connection, partnership, endorsement, or sponsorship of any kind with any artist, band, musician, performer, producer, equipment manufacturer, trademark owner, or other rights holder. No such relationship is claimed, implied, or should be inferred from anything in the App.

Where the names of artists, bands, or equipment appear in the App, they are used solely for descriptive, identification, and reference purposes — to describe the general style or character of a sound — and never to suggest any association with, or approval by, the named party.

All tones, presets, and sounds in the App are Eko’s own original creations, drawing only on general inspiration from musical styles and sonic characteristics. They are not samples, recordings, copies, reproductions, or official recreations of any artist’s actual performances, recordings, equipment, or signature sound, and they are not derived from any artist’s proprietary audio or gear. Any resemblance reflects creative inspiration only.

All trademarks, service marks, trade names, and other names or marks referenced in the App are the property of their respective owners, and their use does not imply any relationship between Eko and those owners. 9. Disclaimers

Eko is provided “as is” and “as available”, without warranties of any kind, whether express or implied, to the fullest extent permitted by law. We do not warrant that the Service will be uninterrupted, error-free, or compatible with every device or audio accessory.

10. Limitation of Liability

To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, or consequential damages, or for loss of data, arising from your use of (or inability to use) Eko. Where liability cannot be excluded, it is limited to the amount you paid for the Service in the twelve months before the claim.

11. Changes

We may update the Service and these Terms from time to time. If we make material changes, we’ll update the “Last updated” date and, where appropriate, provide additional notice. Continuing to use Eko after changes take effect means you accept the updated Terms.

12. Termination

You may stop using Eko at any time. We may suspend or end your access if you breach these Terms or if we discontinue the Service. Sections that by their nature should survive termination (such as intellectual property, disclaimers, and limitation of liability) will continue to apply.

13. Governing Law

These Terms are governed by the laws of the State of Israel, and the competent courts of Tel Aviv, Israel will have exclusive jurisdiction, except where mandatory consumer-protection laws of your country provide otherwise.
